Q: Can DPPEA help an organization get out of a violation?
A: DPPEA's compliance assistance efforts do not remove fines or penalties already assessed by regulatory authorities. However, the assistance is intended to prevent recurrence of non-compliance events by improving operating conditions and management systems.

Q: What happens when DPPEa identifies a non-compliance issue at my facility?
A: DPPEa staff are trained to help inspectors or permit writers; however, they are experienced in dealing with environmental compliance in air, water and waste (solid and hazardous). If a staff person identifies a potential or actual source of enviromnental non-compliance, the DPPEA technical representative provides the contact information for the appropriate regulatory agency and encourages the organization to contact the authorities for further evaluation. DPPEA does not contact the regulatory agency on behalf of the organization

Q: Is the information that I provide about my organization confidential?
A: Yes. DPPEa has a written confidentiality policy located at: http://www.enr.state.nc.us/admin/pdf/confidentiality_policy1.pdf which states that:

1. DENR regulatory agencies will not seek to obtain information from the Division of Pollution Prevention and Environmental Assistance or the Small Business Assistance Program about the compliance status of any individual or company for the purpose of taking enforcement action.

2. The Division of Pollution Prevention and Environmental Assistance and the Small Business Assistance Program will maintain the confidentiality of information submitted to them by regulated entities to the maximum extent allowed by law, unless the dissemination of such information is necessary to abate of avoid an imminent hazard to human health or the environment.

Q: How soon could DPPEA visit my facility?
A: Typically, DPPEA can be on-site within two to three weeks. However, the organization is in a non-compliant situation, assistance will be provided immediately.
